Duke Lawyers Fire Back at Andrew Giuliani

Duke is sure getting themselves some attention. What is it with their sports and the law? First lacrosse, then football, and now golf. Now we are embarking on the legal saga of Andrew Giuliani. Giuliani sued Duke last month. He alleged that he’d been improperly dismissed from the golf team.

Now, the Duke Chronicle reports that Donald Cowan and Jim Cooney, attorneys for the University and head golf coach O.D. Vincent - have filed a motion for judgement on the pleadings. From the looks of it, they’re playing the privilege card.

“Andrew Giuliani is entitled to no more privileges than any other member of the Duke University student body,” the motion says. “Like every other member of the student body, Andrew Giuliani is responsible for both his actions and their consequences.”

The response, reports the Chronicle, says Giuliani’s conduct — including breaking a club, “gunning” the engine of his car, throwing an apple at the face of former teammate and being disrespectful to a trainer — would have merited a dismissal, which was unrelated to his golfing ability. Team members did not take opportunities to vouch for Giuliani, and the response notes that five of six players specifically recommended that Giuliani’s membership be “terminated.”

Giuliani’s mother, Donna Hanover, told The Chronicle that the family had exhausted all avenues to communicate their grievances. But Duke’s filing says that Giuliani, his parents and counsel “repeatedly sought to avoid [and] … to maneuver around” Duke’s codified three-step review process.

If your legal problem is complicated, you might not want to handle the matter without a lawyer. Lawyers do more than dispense legal information.  ”The Super Lawyers selection process includes peer nominations, a blue ribbon panel review and independent research of candidates,” wrote William White, Publisher of Super Lawyers and Law & Politics in the acceptance letter received by Mr. Ingerman.   

Here’s how the selection process works:

    — Super Lawyers surveys lawyers each year who have been in practice for at least five years asking them to nominate the best attorneys they have personally observed. Lawyers cannot nominate themselves and if they nominate someone from their firm, they must also submit a nomination for someone outside their firm. Nominees can be in private practice, in-house counsel, prosecutors, and legal aid attorneys.
    — Research staff at Super Pages speaks with law firms and searches periodicals, legal trade journals, and databases for other qualified names.

Tips to Hiring a Great Personal Injury Lawyer

If you suffer an injury resulting in significant damages you will need to hire a personal injury lawyer. But in any given city, there are probably over 20 pages of personal injury attorney listings in the phone book. How do you pick the right one? What do you look for? What questions should you ask?Here are 7 things you should know before hiring your injury lawyer…

7) Always be completely open and honest when discussing your case with a lawyer. Tell the lawyer as much as you can about what happened. Try to remember every detail. Any documentation and pictures you have of your injuries and treatment will be a big help when evaluating your case.

Bonus Tip:

8) NEVER give a recorded statement to a representative from any insurance company until you’ve consulted a lawyer. When the rep. asks for one simply say, “I’m not prepared to give a statement at this time.” A recorded statement can be used as evidence and if you’re not prepared you might overlook important details. Anything you miss (or misrepresent) can be used against you in settlement negotiations and in the trial.
